HKIFA Webinar – Navigating the US Outbound Investment Rule

HKIFA hosted an insightful webinar featuring Kenneth J. Nunnenkamp, Partner at Morgan Lewis, who provided an overview of the US Outbound Investment Rules and the implications for fund investments.

The Rules, effective January 2025, aim to regulate outbound investments in specific technologies in China, such as semiconductors and certain AI/quantum technologies, due to national security concerns.  Covered transactions involving US persons (including US citizens investing in funds) are either prohibited or require notifications, posing compliance challenges for asset managers.

Nunnenkamp also discussed the America First Investment Policy, which could add another layer of complexity for US outbound investments.
